Clause 20 of the FIDIC 2017 editions represents a major shift in claim administration. Unlike the 1999 editions, the 2017 suite imposes reciprocal time-bars on both the Contractor and the Employer.
Condition Precedent
The notice of claim is now a 'condition precedent' to any entitlement. If the notice is not given within the 28-day window, the claiming party is deemed to have waived their rights entirely.
